Terms of Service

1. Abuse & Illegal Activity

• DDoS attacks, IP spoofing, botting, spamming, or any activity that could blacklist our IPs.
• Pornography is strictly forbidden. This includes hosting, sharing, linking, or distributing adult content of any kind on our servers. Violations may result in immediate account suspension or termination.
• Distribution, creation, or hosting of illegal content including child exploitation, AI-generated child pornography, images of deceased minors, weapons, or any content prohibited by law. Authorities will be contacted immediately.
• Harassment, threats, or any activity that infringes on the rights of others.

2. Resource Usage

• NVMe storage and RAM are dedicated.
• CPU and network are shared; network bandwidth is 1 Gbps per node. Abuse of bandwidth may result in throttling to 100 Mbps.
• Persistent CPU usage at 100% 24/7 affecting other users may result in suspension or termination.
• You may not run cryptominers or other high-load processes that negatively impact shared resources without prior approval.

3. Prohibited Actions

You may not use our services to:

• Violate local, state, federal, or international law.
• Host, transmit, or distribute malware, viruses, or malicious code.
• Spam, phishing, or send unsolicited communications.
• Host copyrighted content without authorization, or content promoting hate, violence, or harassment.
• Attempt unauthorized access to any network, server, or system.
• Use peer-to-peer networks (e.g., torrents) without secure VPN tunneling (e.g., ProtonVPN, MullVad) between your server and the client.

We reserve the right to suspend or terminate accounts violating these rules without prior notice.

4. Anti-DDoS Protection

• We provide only basic DDoS protection, limited to 2 Gbps. You are responsible for securing any services that are frequently targeted, such as game servers or high-traffic websites.
• For game servers, use a reverse proxy such as HAProxy hosted on a separate server with DDoS protection, or services like TCPShield or NeoProtect.
• You may also use a VPN tunnel to secure your server.
• For websites, use a proxy or CDN such as Cloudflare to protect against DDoS and other threats.
• Failure to secure your services may result in downtime or service termination, and we are not liable for any attacks or losses incurred.

5. Uptime & SLA

• Monitor uptime at status.spacehost.ovh.
• Any downtime, regardless of cause, will result in additional time added to your server expiration proportional to the duration of the downtime.
• We do not guarantee 100% uptime and are not liable for interruptions caused by maintenance, third-party failures, or force majeure events.

6. VPS Activation

• VPS servers are manually activated and will be ready within 24 hours.

7. Billing & Payments

• Services are billed monthly in advance.
• Payments are non-refundable unless explicitly stated.
• Late or failed payments may result in service suspension.
• Servers may be terminated 7 days after a missed payment.
• You have 30 days to pay and reactivate; otherwise, data may be permanently deleted.
• Pricing changes will be communicated in advance.

8. Data & Backups

• You are responsible for your data. Regular backups are required.
• Backup solutions may be provided but are not guaranteed.
• We are not liable for data loss, corruption, or unauthorized access.

9. Termination & Suspension

• You may terminate your account or server at any time.
• We may suspend or terminate accounts immediately for TOS violations.
• Upon termination, all data may be deleted unless otherwise agreed.

10. Security & Compliance

• Keep your login credentials secure.
• Report suspected account compromise immediately.
• We comply with privacy and data protection laws but may disclose data if required by law.
• Users must ensure their actions comply with all relevant regulations and policies.
